How will I use your song to be featured in TV or Film?
Typically, if you stumble into our music publishing catalog website; we allow users to download our songs that can be used for their project. However, as it has been said in the terms and conditions, only if you intend to use our songs for commercial projects that you need to secure a license from us.
Many might ask:
1. What license will you provide?
In this page: http://www.ascap.com/filmtv/faq.html, it has been said that any film makers/TV music directors should asked permission to obtain two rights to use our song specifically to be used for TV or Film:
a. Synchronization rights
b. Master use rights
“Synchronization right” is a right to use our song together with your visual image, while the “Master use rights” is the right to use the sound recording.
Now, since we own both the sound recording and song copyrights, we can issue both Sync and Master use license and bundle it together as one agreement. Since we issue free license, there is no associated licensing fee to acquire synchronization and master use rights.
Also issuing a licensing agreement is optional only if your production company requires it (which we recommend, some may not especially amateur film makers who are in the rush). However we do require that you will submit to us a licensing application , since we use this to track the licenses we issued and to provide a copy to ASCAP if necessary.
If you have additional questions pertaining to licenses, feel free to contact us.
The most important thing is to give us a shout if you intend to use our songs for any commercially related projects.
2. What if I decide to include your song in a movie soundtrack compilation album?
This means you are planning to include our song in a physical recorded medium (CD, DVD, cassette, etc ). In relation to this, you need to secure “mechanical rights” from us. This is entirely different and is not covered in a synchronization and master use rights agreement.
You must state this in your licensing application that you wish to include our songs in a soundtrack album so that we can include and issue you mechanical license. As of December 2009, we are not still affiliated with Harry Fox agency, so we are the one to issue mechanical license (as a music publisher).
3. What about performance right fees?
Of course, once your film and TV project has been officially released and to be shown in various TV channels or movie theatres, ASCAP will be collecting performance royalties on our behalf. To speed up the royalty processing, ASCAP will be using the information collected on the licensing application which you submitted to us.
4. Can I do a fact-checking on your catalog/publisher background?
Some movie and TV production companies are afraid to deal with young music publishers because they appear to be less trusted than older publishers. I understand this situation and I am very willing to be fact-checked. In relation to this, below is the information you need:
